Terms of Service
These terms are an agreement between you and Nexus POS ("we", "us"), the operator of Nexus POS. They cover the Nexus POS website at https://nexuspos.co, the web app and the mobile apps (together, "Nexus" or the "service"). By using Nexus, you agree to these terms. If you use Nexus for a business, you agree on behalf of that business.
The short version
- Nexus is in early access. It is provided as is, and every feature is free for now.
- You are responsible for your business: your taxes, your records, your legal compliance and your agreements with payment processors.
- Do not misuse the service.
- Our liability is limited.
1. The service
Nexus is point-of-sale software for small businesses. It helps you ring up sales, take payments through providers you choose, track stock and expenses, and keep customer records.
Nexus is in early access. Features may change, break or be removed. Your data may be stored on your device, in your Claude account if you use Nexus as a Claude artifact, or on a Nexus server. Our Privacy Policy explains how we handle data.
2. Accounts
- Give accurate information and keep your password and PINs private.
- You are responsible for what happens under your account and on your devices.
- If you are the business owner, you decide who to invite to your team and what they can do. You are responsible for their use of Nexus.
- Tell us at support@nexuspos.co if you think someone has accessed your account without permission.
- You must be old enough to form a binding contract where you live, and at least 16.
3. Your responsibilities as a merchant
Nexus is a tool. You run your business. You are responsible for:
- Taxes. Setting the right tax rates, and collecting, reporting and paying taxes. Nexus calculations are not tax advice.
- Legal compliance. Following the laws that apply to your business, including consumer, privacy, marketing, employment and record-keeping laws.
- Your customers' data. You control the customer records you enter. Have a lawful reason to collect them, tell your customers how you use them, respect their marketing choices, and answer their requests to see or delete their data.
- Payment processors. Card and crypto payments go through providers you choose, such as Stripe, Square, PayPal, Authorize.net, Clover, BTCPay, Coinbase Commerce, NOWPayments or BitPay, or your own wallet. Your agreement with each provider is between you and them. Their fees, holds, disputes and chargebacks are yours to handle. We are not a payment processor and do not hold your funds.
- Crypto wallets. Keep your wallet secure. We never ask for private keys or seed phrases. Check that wallet addresses you enter are correct. Crypto payments are usually irreversible.
- Accurate records. Check that your prices, stock, sales and reports are correct. Keep your own backups, especially in local mode, where clearing your browser or losing your device can erase data.
4. Plans and payments
Every feature is free during early access. We plan to offer these plans:
| Plan | Price |
|---|---|
| Free (the basics) | $0 |
| All Access | $1 per month, or $10 per year, per business |
Plans and prices may change before they launch. We will show the price before you pay.
- You pay for plans on our website, through a payment processor.
- Subscriptions renew automatically until you cancel.
- You can cancel any time. You keep access until the end of the period you paid for.
- We do not refund partial periods, except where the law requires it.
- If you cancel All Access, your business moves to Free and keeps its data.
5. Acceptable use
Do not use Nexus to:
- Break the law, or sell goods or services that are illegal where you operate.
- Commit fraud, launder money or evade sanctions.
- Send spam or messages people did not agree to receive.
- Collect or use other people's data without a lawful basis.
- Access accounts or data that are not yours.
- Attack, overload, probe or reverse engineer the service, or get around rate limits or security.
- Upload malware or harmful code.
- Post unlawful, abusive or misleading content on the idea board.
6. Your data and our software
- Your business data belongs to you. You give us permission to store and process it only to run the service for you.
- If you post ideas or feedback, we may use them to improve Nexus, with no obligation to you.
- The Nexus software, name and design belong to us or our licensors. These terms give you a right to use the service, not ownership of it.
7. Third-party services
Nexus connects to services we do not control, such as payment processors, blockchain data sources, exchange-rate providers, email providers and Claude. Their terms apply to your use of them. We are not responsible for their availability, accuracy or actions.
8. No warranty
Nexus is provided "as is" and "as available", especially during early access. To the extent the law allows, we make no warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that Nexus will be uninterrupted, error-free or secure, or that data will never be lost. Exchange rates and payment confirmations come from third parties and may be wrong or delayed.
9. Limitation of liability
To the extent the law allows:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, sales, data or goodwill.
- Our total liability for any claim about Nexus is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50.
Some places do not allow these limits. If so, they apply only as far as the law permits. Nothing in these terms limits liability that cannot be limited by law.
10. Indemnity
If someone makes a claim against us because of your business, your data, your customers, your payment processor agreements, or your breach of these terms or the law, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
11. Termination
- You can stop using Nexus at any time. You can delete your login or your business data as described on Delete your account.
- We may suspend or end your access if you break these terms, if the law requires it, or to protect the service or other users. Where reasonable, we will tell you first and give you a chance to export your data.
- We may end the service or the early-access program. If we do, we will try to give reasonable notice.
- Sections that by their nature should survive, such as responsibilities, no warranty, limitation of liability and indemnity, continue after termination.
12. Changes to these terms
We may update these terms. We will change the effective date at the top. If a change is significant, we will give notice in the app or by email before it takes effect. If you keep using Nexus after that, you accept the new terms. If you do not agree, stop using Nexus.
13. Governing law
These terms are governed by the laws of the laws of the place where the operator is based, without regard to conflict-of-law rules. This does not take away consumer protections you have under the laws of the place you live.
14. General
- These terms and our Privacy Policy are the whole agreement about Nexus.
- If part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a term right away, we can still enforce it later.
- You may not transfer these terms without our consent. We may transfer them as part of a sale or merger.
